GENERAL TERMS AND CONDITION OF SALES

  1. Scope

The following General Terms and Conditions of Sale (hereinafter referred to as: "GTC") apply to all contracts concluded with the company Vounot (hereinafter referred to as: "Vounot") concerning the acquisition and delivery of goods, regardless of the means of communication used for the conclusion of the contract. We reserve the right to modify these GTC.

  1. Order process

Online ordering

The customer can select and order items on the Vounot online store. The customer can obtain the description of the goods concerned by clicking on the image of the item. He has the possibility to deposit the items he selects in a virtual basket. All selected items are gathered in this cart. In order to continue the ordering process, the customer must click on the "Validate order" button. He thus accesses the virtual cash register of the online store. The customer must first fill in all the mandatory fields of the "Delivery" form. The customer can then choose whether the goods should be sent to the indicated address or to a different address. By clicking on the "Validate your details" button, the customer accesses the "Delivery and payment" page, where he will have to choose the type of payment you want. The customer then accesses an overview of the items ordered, the fees and the address indicated. Here, the customer again has the opportunity to check the accuracy of his order and make changes if necessary. He must also confirm that he has read and accepted the GTC as well as the withdrawal conditions.   1. Correction of input errors

Before placing your order on the Vounot online store, the data you have entered can be deleted at any time within the respective forms using the delete button. You can then correct them by re-entering them in the relevant field of the form. In addition, you can also return to each step of the ordering process by clicking on the relevant tab and proceed to the correction of its content in the fields of the form. The customer can also correct the data provided by clicking on the "Edit" links.

  1. Conclusion of the contract

Online ordering

The presentation of the items in the Vounot online store constitutes a simple non-binding invitation, addressed to the customer with a view to the order of items by the latter. By clicking on the "Order with payment obligation" button, the customer submits a firm offer to purchase intended for the conclusion of a sales contract. Vounot is free not to accept the customer's order. The decision on this matter is a matter for Vounot's free discretion. If no action is taken on an online order, Vounot immediately notifys the customer. If Vounot accepts the customer's offer, the customer receives an electronic shipping confirmation directly after the shipment of his order. This shipping confirmation constitutes the acceptance of the customer's contractual offer by Vounot, thus finalizing the conclusion of the sales contract.

The recipients of your personal data are, where applicable, our payment providers or payment security providers, our delivery providers, our business partners. In the event that this is required by law, your consent is collected or a possibility of refusal is provided to you before any transmission of data.   1. Safeguarding contractual stipulations

Vounot safeguards the contractual stipulations. Insofar as the customer has created a customer account, he can consult the contractual stipulations following a given order, by going to the "Order History" page. In addition, the electronic confirmation of shipment is accompanied by a contract confirmation from which the content of the contract is reflected.

 

  1. Delivery time

Online ordering

If the ordered goods are in stock at Vounot, delivery is made within five working days. Other delays are indicated in the product description. The delivery period runs from the day following receipt of the electronic order confirmation from the customer and expires at the end of the last working day of the indicated period. Saturdays, Sundays and public holidays at the place of delivery are not taken into account for the calculation of the delivery time.

 

  1. Prices

The prices in force are those indicated on the website of the online shop at the time of the order. All rates include VAT and shipping costs.

 

  1. Payment, due date and late payment

Payment of items can be made by card (Visa, MasterCard, Credit Card) or by PayPal. In case of payment by Visa or MasterCard, the account will be debited at the time of shipment of the goods. Payments via PayPal are immediately credited to Vounot When a payment service is used, the terms of that service apply in a complementary way. Vounot reserves the right to exclude certain means of payment in certain cases.

 

  1. Customs fees, taxes and fees

The items ordered are not delivered to the English Islands.

 

  1. Right of withdrawal

You have the right to withdraw without giving reasons within fourteen days. The withdrawal period is fourteen (14) days from the day on which you or a third party designated by you, other than the carrier, takes possession of the last item. Effects of withdrawal

If you withdraw within the deadlines you benefit from an exchange or refund without penalty, with the exception of return costs.

Only products returned complete, in their original packaging and in perfect condition for resale will be accepted. Thus, the products must imperatively be overpacked for transport.

Cash-back returns will not be accepted.

No right of withdrawal

 

The right of withdrawal cannot be exercised for

(a) contracts for the supply of goods which, after having been delivered and by their nature, are inseparably mixed with other articles;

(b) contracts for the supply of audio or video recordings or computer software where they have been unsealed by the consumer after delivery;

(c) contracts for the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.

 

  1. Legal Warranty

In case of defects of the goods sold, the legal warranty applies. Your purchases made on www.vounot.fr are covered by the same guarantees as those offered on our other sales networks.

We offer the same after-sales service as a traditional retailer.

 

In case of manufacturing defects, the product(s) will be immediately exchanged or refunded in the event of such a defect.

  1. Delivery

In the event that all the products ordered are not in stock, Vounot proceeds to a common shipment of the goods as soon as all the ordered items are in stock. If an item ordered by the customer is no longer deliverable because the latter is no longer in stock with Vounot or its suppliers, Vounot reserves the right not to execute the order and to withdraw from any delivery obligation. Any payments made are immediately refunded to the customer. If the ordered goods cannot be delivered after three unsuccessful delivery attempts, Vounot is entitled to terminate the contract. Any payments made are immediately refunded to the customer.

 

  1. Retention of title

The goods remain the property of Vounot until full payment of the sale price.

 

  1. Assignment and Pledge

Vounot reserves the right to assign to third parties its claims due in respect of the sale price and delivery costs resulting from the delivery of goods, including shipping costs. Vounot also reserves the right to pledge the aforementioned claims.

The European Commission is shortly planning to set up an out-of-court conciliation platform (http://ec.europa.eu/consumers/odr/). The purpose of the latter is to give consumers the opportunity to settle disputes relating to their online order without the intervention of a court. As soon as this platform is available, we will provide the link.

 

  1. Batteries and accumulators

Since Vounot's shipments may contain batteries or accumulators, we inform you of the following facts: used batteries may contain polluting substances that can damage the environment or human or animal health in the event of non-compliant storage or disposal. It is forbidden to dispose of them with common household waste. Customers can return free of charge to Vounot the batteries/accumulators acquired from ... after their use or give them free of charge to a public collection centre or in shops.

The discount at the points of sale is free for the end user and is limited to current quantities as well as to the products sold or having been sold at that point of sale. Batteries/accumulators containing polluting substances shall be clearly indicated by the symbol representing a blocked bin. Under the symbol of the crossed-out bin is also the chemical designation of the pollutant concerned. For example: (Pb) lead, (Cd) cadmium, (Hg) mercury. You have the possibility to find this information in the documents accompanying the delivery of the goods or in the instructions for use of the manufacturer.

 

  1. Final provisions

Domestic English law applies to the exclusion of conflict-of-laws rules of private international law and to the exclusion of the Vienna Convention on the International Sale of Goods.
